Two things here are not optional, and aren’t done yet: DMCA is U.S. law, and this business is filled in as based in Israel — the notice process below is still worth having as a widely recognized standard, but a U.S. DMCA safe-harbor registration may not directly protect an Israel-based operator the way it would a U.S. one. Ask a lawyer whether an equivalent process exists under Israeli law and whether registering a U.S. DMCA agent anyway is still worthwhile given who actually visits the Site. Separately, real DMCA safe-harbor protection (the legal shield that keeps a platform from being liable for infringing content a user uploaded) requires actually registering a designated agent with the U.S. Copyright Office at
copyright.gov/dmca-directory (a one-time filing, currently a small fee). Without that registration, this page is a good-faith process but does not carry the same legal protection.
1. Respecting copyright
Every person who submits an image to Pay To Stay represents and warrants, as a condition of using the Site, that they own it or have permission to use it (see Section 6 of the Terms of Service). We respond to clear, valid notices of alleged copyright infringement in the content posted on the Site.
2. How to submit a takedown notice
If you believe your copyrighted work has been used on this Site in a way that constitutes infringement, send a written notice to help.paytostay@gmail.com that includes all of the following:
- A physical or electronic signature of the copyright owner or a person authorized to act on their behalf;
- Identification of the copyrighted work you claim has been infringed;
- Identification of the material you claim is infringing, and information reasonably sufficient for us to locate it (for example, the direct link to the Space or Hall of Fame entry);
- Your contact information — at minimum, an address, telephone number, and email address;
- A statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law;
- A statement, made under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorized to act on their behalf.
A notice missing any of these elements may not be actionable.
3. What happens next
On receiving a valid notice, we will remove or disable access to the identified material and notify the person who submitted it. Removal for a valid copyright claim does not entitle that person to a refund of any payment made to display it (Section 5 of the Terms of Service).
4. Counter-notice
If you submitted content that was removed and believe it was removed in error or misidentification, you may submit a counter-notice to help.paytostay@gmail.com including:
- Your physical or electronic signature;
- Identification of the material removed and its location before removal;
- A statement, under penalty of perjury, that you have a good-faith belief the material was removed as a result of mistake or misidentification;
- Your name, address, and telephone number, and a statement consenting to the jurisdiction of the federal court in your district (or, if outside the U.S., an appropriate judicial district) and that you will accept service of process from the person who filed the original notice.
We may, at our discretion and as permitted by law, restore the material after receiving a valid counter-notice, unless the original complainant informs us they have filed a court action.
5. Repeat infringers
We reserve the right to bar any person or email address from the Site who is the subject of repeated valid infringement notices.
6. Trademarks
The Pay To Stay name and logo are the property of Ben Nasan, sole proprietor, operating as Pay To Stay. Third-party trademarks that may appear in content submitted by users belong to their respective owners, and their appearance does not imply endorsement of, or by, Pay To Stay.
